Maysir, where investing becomes gambling
Every Muslim in crypto gets asked whether it is just gambling. There is a precise answer, and it has nothing to do with how risky it feels.
The definition
Maysir needs three things at once:
- Something of value is staked.
- The outcome turns on an uncertain event.
- The transfer is zero sum, meaning one side's gain is exactly the other side's loss, and nothing is produced.
Miss any one of the three and it is not maysir.
Why buying an asset is not gambling
You hand over money and receive a thing. It is yours. If the price falls, nobody pockets your loss as their winnings, the value simply changed. Something real was produced along the way, whether that is a network being secured or a business trading.
That is ownership risk, and it is the same risk carried by a shop, a field or a house.
Why a perpetual future is gambling
Two people take opposite sides on a price. One is paid exactly what the other loses. No asset changes hands and nothing is built.
All three conditions, met precisely. The same applies to prediction markets and binary options, however they describe themselves.
Why paying to enter matters
There is a useful test hiding in the first condition. If entry is free and a prize is funded by someone other than the participants, most scholars permit it, because nobody staked anything and nobody's loss funds anyone's win.
If entry costs money and the prize pool is built from the entry fees, that is a wager wearing a competition's clothes. This is why a free airdrop is a gift, and a paid trading competition where the top entrants split everybody's fees is not.
The uncomfortable middle
Buying a token you know nothing about because a stranger online said it would rise is not maysir by contract. You did receive the asset, and it is yours.
But the intention was a wager, and the scholars warn about that separately from the contract. Permissible by structure is not the same as wise, and it is not the same as blameless.
In one line: gambling is a zero sum bet where nothing is produced, and owning an asset is not that, however violently the price moves.
Maysir is haram. The structure of the contract decides it, not how risky the trade feels, and owning an asset is not a wager however much the price moves.
